  • "You" or "your" refers to the individual or entity accessing our website or using our services.
  • "Services" refers to photography sessions, image editing, digital or printed photographs, and any other photography-related services we provide.
  • "Content" refers to all information, text, images, graphics, videos, and other materials on our website or produced through our services.

Use of Our Website

Permitted Use

You may use our website for lawful purposes and in accordance with these Terms. You may view, download, and print content from our website for your personal, non-commercial use only.

Prohibited Use

You agree not to:

All content on our website, including but not limited to text, graphics, logos, images, photographs, videos, and software, is the property of Pebble Street or our content suppliers and is protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Photography Services and Deliverables

When we provide photography services to you:

  • Pebble Street retains copyright ownership of all photographs we create, unless otherwise agreed in writing.
  • When you purchase our services, you are granted a license to use the photographs as specified in your service agreement.
  • The license granted to you is non-exclusive and non-transferable, unless otherwise specified in writing.
  • You may not edit, alter, or modify our photographs without our express written permission, unless otherwise agreed.
  • Any use of our photographs beyond the scope of your license requires additional permission and may require additional fees.

Model Release

You grant Pebble Street the right to use photographs of you and/or your property for our portfolio, marketing materials, competitions, and other promotional purposes, unless otherwise specified in writing. If you wish to restrict our use of your images, please inform us in writing prior to your photography session.

Booking and Payment

Booking Process

To book our services, you must:

  • Submit a booking request through our website, by email, or by phone
  • Receive confirmation from us that we can accommodate your request
  • Pay the required deposit or full payment as specified in our correspondence
  • Complete any required booking forms or agreements

Deposits and Payment

Unless otherwise specified:

  • A non-refundable deposit of 30% of the total fee is required to secure your booking.
  • The remaining balance is due 14 days before the scheduled photography session or as specified in your booking confirmation.
  • For last-minute bookings (less than 14 days before the session), full payment is required at the time of booking.
  • Payment can be made by credit/debit card, bank transfer, or other methods as specified by us.

Pricing

All prices displayed on our website or quoted to you are:

  • Subject to change without notice until a booking is confirmed
  • Inclusive of VAT where applicable
  • Exclusive of travel expenses beyond our local area, unless otherwise specified

Cancellation and Rescheduling

By You

If you need to cancel or reschedule a confirmed booking:

  • Cancellations made more than 30 days before the session: The deposit is non-refundable, but may be applied to a rescheduled session within 6 months.
  • Cancellations made 14-30 days before the session: 50% of the total fee is payable.
  • Cancellations made less than 14 days before the session: 100% of the total fee is payable.
  • Rescheduling requests are subject to our availability and may incur additional fees.

By Us

In the unlikely event that we need to cancel or reschedule your session:

  • We will attempt to provide you with as much notice as possible.
  • We will offer to reschedule your session to the next available date.
  • If rescheduling is not possible, we will refund any payments you have made in full.
  • Our liability is limited to the refund of any payments made to us for the cancelled session.

Force Majeure

Neither party shall be liable for failure to perform their obligations under these Terms if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service, or any other event outside the reasonable control of the parties.

Delivery of Images

Timeframes

Unless otherwise specified in your booking confirmation:

  • A selection of preview images may be provided within 7 days of your session.
  • Final edited images will be delivered within 4 weeks of your session or 4 weeks from your selection of images (if applicable).
  • Rush delivery may be available for an additional fee.

Delivery Method

Images will be delivered as specified in your booking confirmation, which may include:

  • Digital download via an online gallery
  • USB drive or other physical media
  • Printed photographs or albums

Image Selection and Editing

Unless otherwise specified:

  • We will select the best images from your session for editing.
  • The number of final images will depend on your package and the nature of the session.
  • Basic editing (color correction, exposure adjustment, cropping) is included in our standard packages.
  • Advanced retouching (skin smoothing, object removal, etc.) may incur additional fees.
  • We maintain creative control over the editing style, consistent with our portfolio.

Client Responsibilities

You agree to:

  • Arrive on time for scheduled sessions.
  • Provide accurate information when booking our services.
  • Cooperate with our reasonable instructions during photography sessions.
  • Obtain any necessary permissions for photography at your chosen location, if applicable.
  • Inform us of any specific requirements or requests before the session.
  • Ensure that all subjects to be photographed (or their parent/guardian for minors) have consented to being photographed.

Limitation of Liability

To the maximum extent permitted by law:

  • Pebble Street shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our services.
  • Our total liability for any claims arising from or related to our services shall not exceed the amount you paid to us for the services giving rise to the claim.
  • While we take reasonable care to ensure the safety of our equipment and your property during photography sessions, we cannot accept liability for any damage to property or persons unless caused by our negligence.

Indemnification

You agree to indemnify, defend, and hold harmless Pebble Street and our affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

Privacy

Our collection and use of personal information in connection with your use of our website and services is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on our website with the effective date. Your continued use of our website or services after any changes to these Terms constitutes your acceptance of such changes.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or terms referenced herein, constitute the entire agreement between you and Pebble Street regarding your use of our website and services.
